Please read these terms carefully before using Tecmaze services.
Effective: 1 January 2025These Terms and Conditions ("Terms") govern your access to and use of services provided by Tecmaze Pty Ltd (ABN 81 634 225 296), a company registered in Victoria, Australia ("Tecmaze", "we", "us", or "our").
By signing up for, accessing, or using any Tecmaze service, you ("Client", "you") agree to be bound by these Terms. If you do not agree, do not use our services.
These Terms constitute a legally binding agreement between you and Tecmaze Pty Ltd. We recommend you keep a copy for your records.
Tecmaze provides digital services to Australian local businesses including, but not limited to:
The specific services provided to you are as agreed in writing (email, proposal, or order confirmation) at the time of engagement. Tecmaze reserves the right to modify or discontinue features with reasonable notice.
We aim to maintain 99% uptime for hosted websites and monitoring systems. Scheduled maintenance, force majeure events, or third-party outages (including hosting providers, DNS providers, or email delivery platforms) may result in temporary unavailability for which Tecmaze is not liable.
Tecmaze services are offered on a monthly subscription basis. Current plans are displayed on our website at tecmaze.org. Pricing is in Australian Dollars (AUD) and is inclusive of GST unless stated otherwise.
A one-time setup fee applies to new engagements as stated in your plan details. This fee covers initial build, configuration, testing and onboarding. Setup fees are non-refundable once work has commenced.
Monthly subscription fees are billed in advance via Stripe. By providing payment details, you authorise Tecmaze to charge your nominated payment method on the agreed billing cycle. You are responsible for ensuring your payment details remain current and accurate.
Tecmaze may adjust pricing with a minimum of 30 days' written notice. Your continued use of services after the effective date of a price change constitutes acceptance of the new pricing.
All transactions are processed securely via Stripe. Tecmaze does not store your payment card details.
You may cancel your Tecmaze subscription at any time by providing written notice to [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to services until that date.
Monthly subscription fees already charged are non-refundable upon cancellation. One-time setup fees are non-refundable once work has commenced. Tecmaze will consider refund requests on a case-by-case basis where services were not delivered as agreed — please contact us within 14 days of the issue arising.
There are no lock-in contracts. You may cancel at any time without penalty, subject to the notice terms above.
By using Tecmaze services, you agree to:
You retain ownership of all content, logos, images and business information you provide to Tecmaze. You grant Tecmaze a non-exclusive, royalty-free licence to use that content solely for the purpose of providing services to you.
All website code, templates, chatbot configurations, tools and platform infrastructure developed by Tecmaze remain the intellectual property of Tecmaze Pty Ltd. Upon full payment and while your subscription is active, you are granted a licence to use the website and chatbot built for you. This licence ends if your subscription is cancelled or terminated.
Tecmaze may reference your business name and website as a case study or portfolio example, unless you request otherwise in writing.
Tecmaze provides AI-powered chatbot systems ("AI Receptionist") as part of its services. By using this feature, you acknowledge and agree to the following:
The AI chatbot is not a substitute for professional advice. It is configured to provide factual, general information about your business only — including hours, services, pricing and booking routing. It must not be configured or used to provide clinical advice, legal advice, financial advice, or emergency response.
Tecmaze configures chatbots in good faith based on information provided by the client. The client is ultimately responsible for ensuring the chatbot's responses comply with all applicable laws and regulations, including AHPRA guidelines where relevant.
For clients operating regulated health services (including GP clinics, dental practices, physiotherapy, chiropractic, psychology, optometry and other registered health professions), the following applies:
AHPRA penalties for advertising breaches can reach $10,000 per offence for a body corporate and $5,000 per offence for an individual. Tecmaze accepts no liability for advertising compliance decisions made by the client.
To the maximum extent permitted by Australian law:
Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law, including guarantees as to acceptable quality and fitness for purpose.
You agree to indemnify, defend and hold harmless Tecmaze Pty Ltd, its officers, employees and contractors from and against any claims, losses, damages, penalties and costs (including legal costs) arising out of or in connection with:
Either party may terminate the agreement by providing written notice. Tecmaze may terminate your access immediately and without notice if:
Upon termination, your access to the admin panel, chatbot and hosted website will be suspended. Tecmaze will provide a reasonable opportunity to retrieve your content before permanent deletion, typically within 30 days.
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria. Tecmaze encourages resolution of disputes through good-faith negotiation before commencing legal proceedings.
Tecmaze may update these Terms from time to time. Where changes are material, we will notify you by email at least 14 days before they take effect. Your continued use of services after the effective date constitutes acceptance of the updated Terms. The current version is always available at tecmaze.org/terms.html.
